    This Cookie Policy (this “Policy”) is incorporated into and forms an integral part of the VetClaims.ai Privacy Policy and Terms of Service entered into by and between you (“User,” “you,” or “your”) and PatriotClaims LLC, a Texas limited liability company with its principal place of business located at 14205 Burnet Road, Suite 570, PMB 553893, Austin, Texas 78728-6529 (“Company,” “we,” “us,” or “our”). This Policy explains the Company’s use of cookies, web beacons, pixels, local storage, and other tracking technologies (collectively, “Cookies” or “Tracking Technologies”) on the VetClaims.ai platform, including the website located at https://vetclaims.ai/, any mobile applications (iOS and Android), and all related services, features, content, and functionality (collectively, the “Platform” or “Services”).

    By accessing, browsing, or using the Platform or Services in any manner, you consent to the use of Cookies as described in this Policy, subject to your browser settings, device settings, and the rights provided to you under applicable data protection laws, including but not limited to the Health Insurance Portability and Accountability Act of 1996, as amended (“HIPAA”), the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), the General Data Protection Regulation (“GDPR”), and other federal, state, and international privacy laws.

    I. WHAT ARE COOKIES AND SIMILAR TRACKING TECHNOLOGIES?

    A. Cookies

    Cookies are small text files that are placed on your computer, smartphone, tablet, or other device (collectively, “Device”) by websites you visit. Cookies serve various functions, including enabling websites to recognize your Device, remember your preferences and settings, authenticate your identity, maintain your session, analyze your usage patterns, and deliver personalized content and advertisements. Cookies typically contain a unique identifier, the name of the website that placed the cookie, the expiration date of the cookie, and other information.

    Cookies may be classified as:

    1. Session Cookies: Session cookies are temporary cookies that are stored in your Device’s memory only during your browsing session and are automatically deleted when you close your browser. Session cookies are used to maintain your session state, enable navigation between pages, and remember information you have entered during your visit.
    2. Persistent Cookies: Persistent cookies remain on your Device after you close your browser and are stored until they expire (based on the expiration date set by the website) or until you manually delete them. Persistent cookies are used to remember your preferences, settings, login credentials, and other information across multiple browsing sessions and visits to the website.
    3. First-Party Cookies: First-party cookies are set by the website you are visiting (in this case, vetclaims.ai) and can only be read by that website. First-party cookies are typically used for essential website functions, authentication, preferences, and analytics.
    4. Third-Party Cookies: Third-party cookies are set by domains other than the website you are visiting, such as advertising networks, analytics providers, social media platforms, or content delivery networks. Third-party cookies are used for cross-site tracking, targeted advertising, social media integration, and third-party analytics.

    B. Similar Tracking Technologies

    In addition to cookies, the Company may use other tracking technologies that function similarly to cookies, including but not limited to:

    1. Web Beacons (Pixels or Clear GIFs): Web beacons are small, transparent graphic images (typically 1×1 pixel in size) embedded in web pages, emails, or advertisements. Web beacons are used to track whether a user has viewed a particular web page or email, to monitor user behavior, and to gather information such as IP addresses, browser types, and time stamps. Web beacons are often used in conjunction with cookies to collect and transmit information to third-party servers.
    2. Pixel Tags: Pixel tags are similar to web beacons and are small pieces of code embedded in web pages or emails that allow the Company or third parties to collect information about user interactions, such as clicks, page views, conversions, and other events.
    3. Local Storage (HTML5 Storage): Local storage, also known as HTML5 storage or web storage, allows websites to store data locally on your Device’s browser. Local storage can store larger amounts of data than cookies and does not expire automatically. Local storage is used to store user preferences, application data, cached content, and other information to enhance performance and user experience.
    4. JavaScript and Other Scripts: The Company may use JavaScript, Flash, and other scripting technologies to collect information about your interactions with the Platform, including clicks, mouse movements, scrolling behavior, form submissions, and other user actions.
    5. Device Fingerprinting: Device fingerprinting is a technique that collects information about your Device’s configuration, including operating system, browser type and version, screen resolution, installed fonts, plugins, time zone, language settings, and other characteristics, to create a unique “fingerprint” that can be used to identify and track your Device across websites and sessions.
    6. Software Development Kits (SDKs) and Mobile Identifiers: If you access the Platform through a mobile application, the Company may use SDKs and mobile advertising identifiers (such as Apple’s Identifier for Advertisers (IDFA) or Google’s Advertising ID) to collect information about your Device, app usage, and interactions.

    II. CATEGORIES OF COOKIES WE USE

    The Company uses Cookies for the following purposes, categorized by function:

    A. Strictly Necessary Cookies (Essential Cookies)

    Strictly necessary cookies are essential for the operation, functionality, and security of the Platform and cannot be disabled without severely affecting your ability to use the Platform. These cookies enable core functionality such as user authentication, session management, security, fraud prevention, load balancing, and access to secure areas of the Platform. Without these cookies, certain features and services would not be available.

    Examples of strictly necessary cookies include:

    1. Authentication Cookies: Cookies that identify and authenticate Users when they log into their accounts, ensuring that Users remain logged in as they navigate between pages and preventing unauthorized access to user accounts;
    2. Session Management Cookies: Cookies that maintain user session state, preserve information entered by Users during their visit (such as form data or preferences), and enable seamless navigation between pages without requiring Users to re-enter information;
    3. Security Cookies: Cookies that detect and prevent security threats, fraudulent activity, unauthorized access attempts, cross-site request forgery (CSRF) attacks, cross-site scripting (XSS) attacks, and other malicious conduct;
    4. Load Balancing Cookies: Cookies that distribute user traffic across multiple servers to ensure optimal performance, availability, and reliability of the Platform;
    5. Accessibility Cookies: Cookies that remember user accessibility preferences, such as font size, contrast settings, screen reader preferences, or other accommodations for Users with disabilities.

    Strictly necessary cookies are exempt from consent requirements under GDPR Article 6(1)(f) (legitimate interests) and CCPA/CPRA, as they are essential for the provision of the Services requested by the User.

    B. Performance and Analytics Cookies

    Performance and analytics cookies collect information about how Users interact with the Platform, including which pages are visited most frequently, how long Users spend on each page, which links or buttons Users click, which features are used most often, error messages encountered, navigation paths, and other usage statistics. This information is typically aggregated and anonymized and is used to analyze trends, monitor performance, identify issues, optimize user experience, and improve the Platform’s functionality, design, and content.

    The Company may use the following third-party analytics services:

    1. Google Analytics: Google Analytics is a web analytics service provided by Google LLC that tracks and reports website traffic, user behavior, and conversion metrics. Google Analytics uses cookies and other tracking technologies to collect information such as IP addresses (which may be anonymized), Device identifiers, browser types, operating systems, referring URLs, pages viewed, time spent on pages, and user demographics. Users may opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-On available at https://tools.google.com/dlpage/gaoptout.
    2. Mixpanel: Mixpanel is a product analytics platform that tracks user interactions, events, and behavior within web and mobile applications. Mixpanel collects data such as button clicks, page views, feature usage, user flows, and conversion events.     3. Other Analytics Providers: The Company may use additional analytics providers, including but not limited to Adobe Analytics, Segment, Amplitude, Heap, or similar services, to collect and analyze usage data. Information about third-party analytics providers is available in the Company’s Subprocessor List at https://vetclaims.ai/subprocessors.

    Performance and analytics cookies require consent under GDPR Article 6(1)(a) and CCPA/CPRA in certain jurisdictions. By continuing to use the Platform after being notified of the use of such cookies, you consent to their use. You may withdraw consent at any time by adjusting your browser settings or contacting the Company at [email protected].

    C. Functionality Cookies (Preference Cookies)

    Functionality cookies remember your preferences, settings, choices, and customizations to provide a more personalized and tailored user experience. These cookies enable the Platform to remember information you have provided or selections you have made (such as language preferences, region or location settings, display settings, font size, theme or color scheme, saved searches, or favorite content) so that you do not have to re-enter or re-select such information on subsequent visits.

    Examples of functionality cookies include:

    1. Language Preference Cookies: Cookies that remember your preferred language or locale settings;
    2. Display Settings Cookies: Cookies that remember your display preferences, such as dark mode, font size, or layout preferences;
    3. Form Auto-Fill Cookies: Cookies that remember information you have previously entered into forms (such as your name, email address, or other contact information) to auto-fill such information in the future;
    4. Customization Cookies: Cookies that remember your customized settings, dashboard configurations, or personalized content preferences.

    Functionality cookies require consent under GDPR and CCPA/CPRA in certain jurisdictions. By continuing to use the Platform after being notified of the use of such cookies, you consent to their use. You may withdraw consent at any time by adjusting your browser settings or contacting the Company at [email protected].

    D. Targeting and Advertising Cookies (Marketing Cookies)

    Targeting and advertising cookies are used to deliver advertisements that are relevant to your interests, preferences, and browsing behavior, and to measure the effectiveness of advertising campaigns. These cookies may track your browsing activity across multiple websites and over time to build a profile of your interests, demographics, and online behavior, which is then used to deliver targeted or personalized advertisements. Targeting and advertising cookies may also be used to limit the number of times you see a particular advertisement (frequency capping), to measure ad impressions and click-through rates, and to attribute conversions to specific advertising campaigns.

    AS OF THE EFFECTIVE DATE OF THIS POLICY, THE COMPANY DOES NOT USE TARGETING OR ADVERTISING COOKIES, DOES NOT ENGAGE IN TARGETED ADVERTISING OR CROSS-CONTEXT BEHAVIORAL ADVERTISING, DOES NOT SELL OR SHARE PERSONAL INFORMATION FOR ADVERTISING PURPOSES, AND DOES NOT DISCLOSE PERSONAL INFORMATION TO THIRD-PARTY ADVERTISING NETWORKS OR DATA BROKERS. ACCORDINGLY, USERS DO NOT NEED TO OPT OUT OF THE SALE OR SHARING OF PERSONAL INFORMATION OR TARGETED ADVERTISING.

    If the Company implements targeting or advertising cookies in the future, the Company will update this Policy to reflect such changes and will provide clear notice to Users, obtain opt-in consent where required by applicable law (such as GDPR or ePrivacy Directive), and provide opt-out mechanisms where required by applicable law (such as CCPA/CPRA or state opt-out requirements). Users will have the right to opt out of targeted advertising by adjusting their cookie preferences, using browser-based opt-out tools, or exercising their rights under applicable privacy laws.

    III. THIRD-PARTY COOKIES AND SERVICE PROVIDERS

    Certain cookies used on the Platform are set and controlled by third-party service providers, analytics providers, content delivery networks, social media platforms, and other third parties that provide services to the Company or whose content or features are integrated into the Platform. The Company does not control these third-party cookies, and the use of such cookies is governed by the privacy policies, cookie policies, and terms of service of the respective third parties.

    Third-party service providers that may set cookies on the Platform include, but are not limited to:

    1. Cloud Hosting and Infrastructure Providers: Amazon Web Services (AWS), Microsoft Azure, Google Cloud Platform;
    2. Content Delivery Networks (CDNs): Cloudflare, Fastly, Akamai;
    3. Analytics and Data Intelligence Providers: Google Analytics, Mixpanel, Adobe Analytics, Segment, Amplitude, Heap;
    4. Customer Support and Communication Providers: Zendesk, Intercom, Twilio, SendGrid;
    5. Payment Processing Providers: Stripe, PayPal, Apple Pay, Google Pay;
    6. Security and Fraud Prevention Providers: reCAPTCHA (Google), Cloudflare, Sift Science;
    7. Social Media Platforms: If the Platform includes social media sharing buttons, plugins, or widgets (such as Facebook, Twitter/X, LinkedIn, or Instagram), such platforms may set cookies to track your interactions with their features. The Company does not control these cookies, and their use is governed by the privacy policies of the respective social media platforms.

    Users are encouraged to review the privacy policies and cookie policies of third-party service providers to understand their data collection, use, and disclosure practices. The Company is not responsible for the privacy practices or content of third parties.

    IV. COOKIES AND PROTECTED HEALTH INFORMATION (PHI)

    The Company acknowledges that certain information collected through Cookies may constitute Protected Health Information (“PHI”) as defined under HIPAA if such information relates to the past, present, or future physical or mental health or condition of an individual, the provision of health care to an individual, or payment for health care, and if such information identifies or can be used to identify an individual.

    The Company does not intentionally use Cookies to collect, store, or process PHI unless a Business Associate Agreement (“BAA”) has been executed with the User and all applicable HIPAA requirements have been satisfied. If you are a Covered Entity or Business Associate and believe that Cookies may be used to process PHI in connection with your use of the Platform, you must contact the Company at [email protected] to execute a BAA before providing any PHI to the Platform.

    To the extent that Cookies collect IP addresses, Device identifiers, or other information that could be linked to PHI, the Company will treat such information in accordance with HIPAA, the HITECH Act, the Texas Medical Privacy Act, and the applicable BAA (if any). The Company implements administrative, physical, and technical safeguards to protect PHI processed through Cookies, including encryption, access controls, audit logging, and secure transmission protocols.

    V. MANAGEMENT OF COOKIES AND USER CHOICES

    A. Browser-Based Cookie Controls

    You have the right to accept, reject, or delete cookies through your web browser settings. Most web browsers are configured by default to accept cookies, but you can modify your browser settings to block or delete cookies, to receive notifications when cookies are being set, or to restrict cookies to specific websites.

    Instructions for managing cookies in popular web browsers include:

    1. Google Chrome: Visit https://support.google.com/chrome/answer/95647 or navigate to Settings > Privacy and security > Cookies and other site data, where you can block all cookies, block third-party cookies, or delete cookies;
    2. Mozilla Firefox: Visit https://support.mozilla.org/en-US/kb/clear-cookies-and-site-data-firefox or navigate to Settings > Privacy & Security > Cookies and Site Data, where you can block cookies, delete cookies, or configure exceptions;
    3. Microsoft Edge: Visit https://support.microsoft.com/en-us/microsoft-edge/delete-cookies-in-microsoft-edge-63947406-40ac-c3b8-57b9-2a946a29ae09 or navigate to Settings > Cookies and site permissions > Manage and delete cookies and site data, where you can block or delete cookies;
    4. Apple Safari: Visit https://support.apple.com/guide/safari/manage-cookies-and-website-data-sfri11471/mac or navigate to Preferences > Privacy, where you can block cookies, manage website data, or enable Intelligent Tracking Prevention;
    5. Opera: Visit https://help.opera.com/en/latest/web-preferences/#cookies or navigate to Settings > Privacy & Security > Cookies, where you can configure cookie settings.

    Please note that disabling or deleting strictly necessary cookies may impair or prevent your ability to access or use certain features, functionalities, or areas of the Platform, including the inability to log in, maintain your session, or access secure content. Disabling or deleting performance, analytics, or functionality cookies may result in a less personalized or optimized user experience, but will not prevent you from accessing the Platform.

    B. Opt-Out Tools for Advertising and Tracking

    Although the Company does not currently engage in targeted advertising or cross-site tracking, if you wish to opt out of interest-based advertising or cross-site tracking by third-party advertising networks, data brokers, or analytics providers, you may use the following industry opt-out tools:

    1. Digital Advertising Alliance (DAA) Opt-Out Tool: Visit http://optout.aboutads.info to opt out of interest-based advertising from participating companies;
    2. Network Advertising Initiative (NAI) Opt-Out Tool: Visit http://optout.networkadvertising.org to opt out of interest-based advertising from participating NAI members;
    3. European Interactive Digital Advertising Alliance (EDAA) Opt-Out Tool: Visit http://www.youronlinechoices.eu for Users in the European Economic Area;
    4. Google Ads Settings: Visit https://adssettings.google.com to manage your Google ad personalization settings and opt out of personalized ads;
    5. Facebook Ad Preferences: Visit https://www.facebook.com/ads/preferences to manage your Facebook ad preferences and opt out of interest-based advertising on Facebook;
    6. Global Privacy Control (GPC): If your browser supports Global Privacy Control (GPC), you can enable GPC to automatically signal your opt-out preferences to websites you visit. The Company honors GPC signals where required by applicable law.

    Please note that opting out of interest-based advertising does not mean you will no longer receive advertisements; it means that the advertisements you see will not be tailored to your interests or browsing behavior. Additionally, opt-out tools typically rely on cookies to remember your opt-out preferences, so if you delete cookies, you may need to opt out again.

    C. Mobile Device Settings

    If you access the Platform through a mobile application, you can manage tracking and advertising preferences through your mobile device settings:

    1. iOS Devices (Apple): Navigate to Settings > Privacy & Security > Tracking, and toggle off “Allow Apps to Request to Track.” You can also navigate to Settings > Privacy & Security > Apple Advertising and toggle on “Personalized Ads” to limit ad tracking;
    2. Android Devices (Google): Navigate to Settings > Google > Ads, and toggle on “Opt out of Ads Personalization.” You can also reset your Advertising ID to disassociate your device from previously collected advertising data.

    D. Do Not Track (DNT) Signals

    Some web browsers offer a “Do Not Track” (DNT) signal that allows Users to indicate their preference not to be tracked online. As of the Effective Date of this Policy, there is no common industry standard, legal requirement, or technical specification for recognizing, implementing, or responding to DNT signals. Accordingly, the Company does not currently respond to or honor DNT signals or similar browser-based mechanisms. The Company will continue to monitor developments in DNT technology, industry standards, and legal requirements, and may adjust its practices in the future if a uniform standard or legal obligation is established.

    VI. RETENTION OF COOKIE DATA

    The retention period for data collected through Cookies varies depending on the type of cookie and the purpose for which the data was collected:

    1. Session Cookies: Session cookies are typically retained only for the duration of your browsing session and are automatically deleted when you close your browser;
    2. Persistent Cookies: Persistent cookies are retained on your Device for a specified period (ranging from a few days to several years, depending on the expiration date set by the cookie) or until you manually delete them;
    3. Analytics Data: Data collected through analytics cookies is typically retained for a period of up to twenty-six (26) months from the date of collection, after which it is anonymized, aggregated, or deleted;
    4. PHI Collected Through Cookies: If any data collected through Cookies constitutes PHI, such data will be retained in accordance with HIPAA requirements (generally six years from the date of creation or the date when last in effect, whichever is later), the Texas Medical Privacy Act (generally ten years for certain health records), and the applicable BAA.

    At the end of the applicable retention period, cookie data will be deleted, anonymized, or aggregated in accordance with the Company’s data retention and destruction policies and applicable data protection laws.

    VII. UPDATES TO THIS COOKIE POLICY

    The Company reserves the right to modify, amend, or update this Cookie Policy at any time in its sole discretion to reflect changes in the Company’s use of Cookies, changes in technology, changes in applicable law, or for any other reason. Material changes to this Policy will be communicated to Users by: (a) posting a revised version of this Policy on the Platform with an updated “Effective Date” or “Last Updated” date; (b) sending an email notification to the email address associated with your account; or (c) displaying a prominent notice on the Platform. Users are responsible for regularly reviewing this Cookie Policy to stay informed of any changes. Continued use of the Platform or Services following notice of changes constitutes acceptance of such changes.

    VIII. STATE-SPECIFIC DISCLOSURES AND RIGHTS

    A. California Residents (CCPA/CPRA)

    For Users who are California residents, the following additional disclosures apply:

    1. Categories of Personal Information Collected Through Cookies: The Company collects the following categories of Personal Information through Cookies: identifiers (such as IP addresses, Device identifiers, cookie IDs, and browser identifiers), internet or other electronic network activity information (such as browsing history, search history, and information regarding interactions with the Platform), and geolocation data (approximate location derived from IP address);
    2. Business Purposes for Collection: The Company uses Personal Information collected through Cookies for the business purposes described in Section II above, including providing the Platform, authentication, security, analytics, performance optimization, and personalization;
    3. No Sale or Sharing of Personal Information: The Company does not sell or share Personal Information collected through Cookies for cross-context behavioral advertising purposes. Accordingly, California residents do not need to opt out of the sale or sharing of Personal Information;
    4. Right to Opt Out of Targeted Advertising: Although the Company does not currently engage in targeted advertising, if the Company implements targeted advertising in the future, California residents will have the right to opt out by adjusting their cookie preferences or contacting [email protected];
    5. Right to Limit Use of Sensitive Personal Information: If Cookies collect Sensitive Personal Information (as defined under CCPA/CPRA), California residents have the right to limit the Company’s use of such information to purposes permitted under CCPA/CPRA § 1798.121(a) by contacting [email protected].

    B. Virginia, Colorado, Connecticut, and Utah Residents

    For Users who are residents of Virginia, Colorado, Connecticut, or Utah, the Company does not engage in targeted advertising, sell Personal Information, or conduct profiling in furtherance of decisions that produce legal or similarly significant effects. Accordingly, residents of these states do not need to opt out of such activities. If the Company’s practices change in the future, residents of these states will have the right to opt out by contacting [email protected].

    C. European Economic Area, United Kingdom, and Switzerland Residents (GDPR)

    For Users who are residents of the European Economic Area, United Kingdom, or Switzerland, the following additional disclosures apply:

    1. Legal Basis for Processing: The Company’s use of strictly necessary cookies is based on legitimate interests (GDPR Article 6(1)(f)) and is necessary for the provision of the Services. The Company’s use of performance, analytics, and functionality cookies is based on consent (GDPR Article 6(1)(a)), which may be withdrawn at any time;
    2. Right to Withdraw Consent: You may withdraw your consent to the use of non-essential cookies at any time by adjusting your browser settings, using cookie preference tools, or contacting [email protected]. Withdrawal of consent will not affect the lawfulness of processing conducted prior to withdrawal;
    3. Right to Object: You have the right to object to the use of cookies based on legitimate interests by contacting [email protected];
    4. Data Transfers: Cookie data may be transferred to and processed in the United States or other countries outside the EEA, UK, or Switzerland. The Company implements appropriate safeguards, including Standard Contractual Clauses and the UK Addendum, to protect such data.
